Yes, under the GBR, septic tanks must not discharge to a watercourse, including drains, ditches, or streams that connect to open water. If your system currently discharges this way, it will be considered non-compliant and requires an upgrade before a property sale can proceed. 

If your system is non-compliant, we may suggest not paying for a compliance survey but coming out free of charge to provide a quote for its replacement that you can use to negotiate with potential buyers.
