Water and sewerage services are provided in England and Wales by ‘water and sewerage undertakers’ who operate under the provisions of the Water Industry Act 1991. Included in the regulations is the right for you to connect to the public sewer of any sewerage undertaker and thereby to discharge foul and surface water from your property.

Sewer connections can be made directly to a public sewer or indirectly to a private drain that is already connected to a public sewer. The rights apply to both existing and new premises, however, the right to connect under Section 106 of the regulations only applies once planning approval has been granted. In addition, you must ensure that you have the necessary permissions to lay your drains in the land between your premises and the public sewer.
This means that connecting to the public sewer can be complicated and can include Section 106 agreements for connection, Section 98 agreements for requisition over 3rd party land, Section 102 and Section 104 agreements for adoption of foul sewers, Section 50 agreements (Highways Act), streetworks regulations (NRSWA), traffic management (TWA) and more.
